The Arizona Department of Education filed a lawsuit July 6 in the U.S. District Court in Phoenix against the U.S. Department of Education and Secretary of Education Margaret Spellings in a dispute stemming from the No Child Left Behind Act. The state maintains that the federal government isn’t honoring a spoken agreement it made with Arizona that the state could exclude the test scores of English-language learners from calculations of adequate yearly progress for the first three years that such students attend U.S. schools.
