The federal judge in Texas who issued an injunction blocking the Obama administration’s guidance on transgender students’ access to restrooms and locker rooms in schools issued an order last week to clarify that the preliminary injunction “applies nationwide” and cannot be limited to the 13 states that have challenged the guidance.
U.S. District Judge Reed O’Connor was responding to motions filed by the Obama administration to clarify his Aug. 21 nationwide injunction. O’Connor said his order was “limited to the issue of access to intimate facilities.”
The U.S. Supreme Court is considering whether to take up the appeal of a Virginia district that is seeking to avoid the guidance, which calls for allowing transgender students to use the facilities with which they identify.
