The New Jersey State Senate last week voted 38 to 0 to confirm the nomination of Mary Lee Fitzgerald, the superintendent of the Montclair public schools, to be the next state education commissioner.

Gov. James J. Florio had nominated Ms. Fitzgerald, who has headed the Montclair schools for the past 10 years, to serve out the term of John Ellis, who resigned last month. That term ends in January 1994.

Ms. Fitzgerald is the first woman to head the state's education system.
